MAPCO Settlement

A settlement has been proposed to resolve legal claims of financial institutions related to a May 2013 data breach.  Any credit union that issued payment cards that were compromised in the breach could get a payment from the class action settlement.

In the proposed resolution agreement, involving lawsuits against MAPCO Express, Inc. and Delek US Holdings, Inc. , MAPCO has agreed to pay $700,000 to resolve the claims brought against it. The lawsuits, WinSouth Credit Union v. Mapco Express, Inc., and First National Community Bank v. Mapco Express, Inc., involve claims that MAPCO was negligent in failing to prevent the breach and that MAPCO violated other laws.

Approximately 185,000 payment cards were compromised.  These include credit cards, debit cards, and other types of payment cards. A credit union or other financial institution unsure if it is included can find out more by visiting the MAPCO settlement page.

The proposed settlement provides two options:

First, affected credit unions can make a claim in a set, per-card amount, without needing to submit documentation of alleged costs and expenses for a maximum of $3.00 per claimed-on account.

Alternatively, credit unions can seek up to 60% of their actual damages, by submitting documentation demonstrating their losses and any amounts received from Visa or MasterCard through those brands’ recovery processes.
